  1. Purpose and acceptance of the General Conditions of Access and Use

Access to and use of the website accessible at the following address: https://www.predesire.com (hereinafter referred to as “the Site”) and the services offered by HSK Partners (hereinafter referred to as “the Site Editor”) are subject to compliance with these Terms and Conditions of Use.

The purpose of the Website is to make available information relating to the activities of the Website Editor. Acceptance of the General Conditions of Use (GCU) constitutes a necessary prerequisite for any browsing and/or use of the Website.

All Users must read the GCU; any access and/or use of the Website implies the acceptance and respect of all the terms of the present GCU.

 

  1. Intellectual Property Rights

The information present on the Site, the registered trademarks, logos, software, texts, images constitute a work protected by the regulations in force on intellectual property.

The databases established by the Site Editor are protected by copyright and by the law of 1 July 1998 transposing into the Intellectual Property Code the European directive of 11 March 1996 on the legal protection of databases.

Except with the Site Publisher’s written authorisation, any reproduction, representation, adaptation, translation and/or modification, in part or in full, as well as any substantial qualitative or quantitative extraction to another platform is prohibited and punishable under articles L.343-4 and following of the Intellectual Property Code.

  • Responsability of the site Editor

The Site Editor makes his best efforts to ensure the proper functioning of the Site and the services within the limits of responsibility provided for in these General Conditions of Use.

  • Site access

The Site is in principle accessible 24 hours a day and 7 days a week. However, the Site Publisher declines all responsibility:

  • In case of interruption of the Site for technical maintenance operations or updating of information;

  • In case of interruption of service, restrictions of access to the network or to specific servers connected to the network, variations in the quality of service that would result from an action or omission of a third party hereto, and which would be totally independent of the will of the Site Editor;

  • In the event of unavailability or overload or any other cause totally independent of the Site Editor and preventing the normal functioning of the network used to access the Site, without any fault being able to be blamed on the Site Editor. In case of contamination by possible computer viruses circulating on the network ;

  • In the event of abnormal use or illicit exploitation of the Site by a User;

  • In case of interruption, suspension, reduction or disturbance of electricity or any interruption of electronic communication networks that would be totally beyond the control of the Website Editor.

 

  • Intervention of the site Editor

The Site Publisher reserves the right to modify the terms, conditions and mentions herein at any time, in particular in the event of technical, legal or jurisprudential developments or when setting up new services.

 

  • Information and content of the site

Given the evolving nature of the information, data and references contained in the Site, they are not contractual. The Site Editor reserves the right to modify, cancel or replace a section or an element of the Site at any time and without notice. The Internet user, visitor of the Site, uses and interprets the data contained under his sole responsibility.   1. Responsability of a user

The use of the Site is made under the sole and entire responsibility of the User.

The User is solely responsible for the information he or she communicates from the Site.

In the event of abnormal use or illicit exploitation of the Site, the User is solely responsible for any damage caused to third parties and the consequences of any claims or actions that may result.

The User also waives the right to take any recourse against the Site Publisher in the event of legal action taken by a third party against him/her as a result of the illicit use and/or exploitation by the User of the Site.

In general, the User undertakes to comply with all applicable regulations and refrains from infringing the rights of third parties.

The creation of hypertext links to the www.predesire.com Site is subject to the prior agreement of the Director of Publication. The Website may contain hypertext links to other websites. These hypertext links to other sites shall in no case incur the liability of the Site Editor.

The Website Editor cannot be held liable for any damage resulting from access to or use of information from third party sites.

  1. Independence of clauses

If any part of these Terms and Conditions of Use should prove to be void, invalid or unenforceable for any reason, the term or terms in question shall be declared non-existent and the remaining terms shall retain their full force and scope and shall continue to be applicable.

 

  1. Attribution of competence

The present conditions and all acts arising therefrom are exclusively governed by French law.

Any dispute arising from the use of the Site shall be submitted to the competent courts of Nanterre, notwithstanding plurality of defendants or appeal in warranty.
